General Terms and Conditions of KOLK 17 gGmbH

KOLK 17 Puppet Theater & Museum is represented by Dr. Antonia Napp, hereinafter referred to as the “Organizer,” for the execution of events such as theater performances at the European Hansemuseum Lübeck and construction site tours at the Organizer's site in Kolk, Lübeck.

Conclusion of Contract

By submitting a written, telephonic, or electronic registration, the customer makes a binding offer to the Organizer for the conclusion of a contract. The contract is concluded when the Organizer confirms the booking in text form based on the General Terms and Conditions.

Scope of Services

The contractual service is derived from the service description and any additional services listed in the booking confirmation. Ancillary agreements that alter the scope of contractual services are only valid if agreed upon in writing.

The Organizer expressly reserves the right to change the meeting point, start time of the tour, or route for construction site tours if significant circumstances necessitate a change, such as a sudden change in weather. The customer will be promptly informed of such changes as described above.

Unused Services

If the customer does not fully or partially use certain services, they are not entitled to a refund or price reduction.

Exclusion

The right of the customer to assign claims from the contract to third parties is excluded. The customer is also not entitled to authorize a third party to assert their claims in their own name. The Organizer reserves the right to exclude intoxicated individuals from an event. There is no entitlement to a refund of the admission price or to claim compensation.

Liability

1. The Organizer is liable within the scope of the due diligence of a prudent merchant for the careful preparation and execution of the event.

2. The liability of the Organizer is limited to the agreed services.

The Organizer is only liable to the customer for damages attributable to the Organizer's fault and only within the framework of statutory provisions. If essential contractual obligations are concerned, the Organizer’s liability for slight negligence is limited to foreseeable damages typical for the contract. Essential contractual obligations are duties arising from the nature of the contract whose violation would jeopardize the purpose of the contract, as well as obligations imposed by the contract on the Organizer for fulfilling the contract, upon which the customer regularly relies. Liability for minor contractual breaches is excluded for slight negligence.

3. The Organizer is not liable for third-party services, even if the Organizer acted as an intermediary.

4. If minors participate in an event, their legal guardians are liable. The Organizer assumes no supervisory responsibilities.

For construction site tours, it is additionally stipulated that the construction site may only be entered by adults, at their own risk, and only with sturdy footwear for safety reasons.

5. The Organizer is liable in accordance with statutory provisions for damages to life, body, and health arising from negligent or intentional breaches of duty by the Organizer, its employees, representatives, or agents.

6. The Organizer is not liable for items lost by participants. Nor is the Organizer liable for items damaged by other participants or third parties.

8. To the extent that the Organizer's liability is excluded or limited, this also applies to the personal liability of its employees, representatives, and agents.

A claim for damages for slight negligence in the breach of essential contractual obligations is limited to foreseeable damages typical for the contract, except in cases of liability for injury to life, body, or health. This also applies to the liability of the Organizer’s agents.

Jurisdiction

The exclusive place of jurisdiction for deliveries, payments, and all disputes arising from the contracts concluded between the Organizer and the customer shall be the location of the Organizer’s business, provided the customer is a registered merchant, a legal entity under public law, or a special fund under public law.

Final Provisions

The invalidity of individual provisions of the contract does not affect the validity of the entire contract.

The museum is currently closed due to renovation and conversion work and will be open to visitors from 29 June. Visit us in our new old home in the Kolk. The opening hours refer to the theatre box office, which is temporarily open mainly during performances.
